Closing on transfer and discount on invoice

This tightening will do very, very badly and risks blocking the construction market. We refer to the tightening of the transfer and invoice discount introduced bysection 26 from Decree-Law Sostegni-ter to appear in the Gazzetta. Indeed, article 26 prohibits other assignments of credit beyond the first. Therefore, just one step from the customer. In addition, credits which on February 7, 2022 have been the subject of a previous sale or discount may be one more transfer.

In reality Article 26 extinguishes the assignment of credit and effectively removes the discount on the invoice. And, if it is not amended by Parliament, it will probably greatly reduce the ardor registered in construction for the past year and a half. An unfortunate and incomprehensible choice. Furthermore, note that section 121 is subject to the twelfth amendment within 18 months.

the Decree-Law Sostegni-ter is entitled “Urgent measures to support businesses and economic operators, labor, health and local services, related to the COVID-19 emergency, as well as to contain the effects of price increases in the sector electricity “. It will probably see the light of day in the Official Journal which will appear this evening.

Curiously, the Government’s press release on Sostegni-ter does not mention the provision of Art. 26 which, moreover, will have a strong impact on construction activity.

The first comments on the squeeze

The first comments from Federlegno and Ance on the toughening introduced by the Draghi government were very harsh.

So the president Claudio Feltrin from Federlegno Arredo he is forced “to recognize that the government has decided to renege on itself, throwing entrepreneurs and families into total chaos and blocking a cutting-edge sector like construction for the whole country”.

And again: “A truly incomprehensible decision, as well as unjustified, which, in fact, would make the option of the discount on the invoice inapplicable by all contractors, small and largewho, precisely on the basis of what was decided with the finance law at the end of the year, planned investments and work plans

Gabriele Buia di Ance also falls hard: “Enough with the continued changes in how the Superbonus works. The uncertainty of the rules, even with retroactive measures, discourages the market and the most serious companies.

The anti-fraud objective is fair, but thousands of legitimate citizens and businesses engaged in energy and seismic redevelopment interventions cannot be continually impacted.. From now on, they will necessarily have to review the contractual conditions with the owners, generating thousands of disputes and a blockage of the market.“.
